Please read these Terms carefully before placing an order. By placing an order on our website, you agree to these Terms of Sale.
1. Who these Terms apply to
These Terms apply to retail purchases made by consumers through cookskava.com.
If you are buying for business, wholesale, resale, or commercial purposes, please contact us before ordering. We may apply separate terms for wholesale or business customers.
2. Our products
Cook’s Kava sells kava root powder and related products.
Our products are sold as food/beverage products and are not medicines. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
You should not use our products as a substitute for medical advice, medical treatment, or a balanced diet. If you are unsure whether kava is suitable for you, speak with a qualified healthcare professional before use.
3. Product warnings
Our products are intended for adults only.
Do not use kava products if you are pregnant or breastfeeding. Do not combine kava with alcohol. Do not use kava if you have liver disease, liver problems, or if you are taking medication, unless you have first spoken with a qualified healthcare professional.
Keep products out of reach of children.
Use products responsibly and follow the preparation and usage information provided on the product page and/or product packaging.
4. Product information
We try to make sure that all product information on our website is accurate, clear, and up to date.
Product pages may include information such as product name, ingredients, net quantity, country of origin, preparation instructions, storage instructions, warnings, and other relevant product details.
Product images are for illustration only. Packaging, labels, colour, texture, and appearance may vary slightly between batches.
5. Availability
All products are subject to availability.
If a product is out of stock after you place an order, we will contact you and either offer a replacement, wait for restock, or cancel and refund the affected item.
We reserve the right to limit quantities, refuse orders, or cancel orders where we reasonably believe there may be an error, legal restriction, safety concern, suspected fraud, misuse of the website, or purchase for unauthorised resale.
6. Prices and VAT
Prices are shown in euros (€).
Prices include VAT where VAT is applicable, unless stated otherwise.
Delivery costs are shown separately before checkout and are added to the total order price before you confirm and pay.
We may update prices from time to time. The price you pay is the price shown at checkout when you place your order, except where there is an obvious pricing error.
If we discover an obvious pricing error, we may cancel the order and refund you.
7. Placing an order
When you place an order, you are making an offer to buy the products in your basket.
Before submitting your order, you will have the opportunity to review your order, delivery details, and total price.
The contract between you and Cook’s Kava is formed when we accept your order by sending an order confirmation email.
We may refuse or cancel an order before dispatch if:
- the product is unavailable;
- payment is not authorised;
- the delivery address is incomplete or incorrect;
- shipment to the destination is restricted or impractical;
- there is an obvious pricing or product information error;
- we suspect fraud, abuse, or unauthorised resale;
- accepting the order may create a legal, regulatory, safety, or customs issue.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.
8. Payment
Payment must be made at checkout using one of the payment methods available on the website.
Your order will not normally be dispatched until payment has been successfully received or authorised.
We do not store your full payment card details. Payment processing is handled by third-party payment providers.
9. Delivery
We ship from Greece to selected destinations.
Delivery options, delivery costs, and estimated delivery times are shown at checkout where available.
Unless otherwise agreed, we aim to deliver orders without undue delay and no later than 30 days after the order is accepted.
Delivery times are estimates and are not guaranteed. Delays may occur due to courier issues, public holidays, customs checks, strikes, weather, incorrect address details, or events outside our control.
You are responsible for providing a complete and accurate delivery address. If an order is delayed, lost, returned, or requires reshipment because you provided incorrect or incomplete delivery information, you may be responsible for additional delivery costs.
10. Delivery restrictions
Kava products may be treated differently in different countries.
We ship only where we are reasonably able to fulfil orders. We reserve the right to cancel and refund orders where shipment to the destination country may be restricted, impractical, or legally uncertain.
If you order from outside Greece, you are responsible for making sure that the product can lawfully be purchased, imported, possessed, and used in your destination country.
If a parcel is refused, delayed, seized, destroyed, or returned by customs or another authority because of local restrictions, we may not be able to refund delivery costs or product costs unless required by applicable consumer law.
11. Risk and delivery
For consumer orders, the risk of loss or damage passes to you when you, or a person chosen by you, receives physical possession of the goods.
If your parcel arrives damaged, please contact us as soon as possible at support@cookskava.com with your order number and photos of the parcel and damaged goods.
12. Your right to withdraw from an online purchase
If you are a consumer in the EU, you normally have the right to withdraw from an online purchase within 14 days without giving a reason.
The withdrawal period expires 14 days after the day on which you, or a person chosen by you, receives the goods.
To exercise your right of withdrawal, you must inform us clearly before the withdrawal period expires.

You may use the withdrawal form at the end of these Terms, but you do not have to use that exact form.
13. Returns of food products
For food safety and hygiene reasons, returned products must be unopened, sealed, unused, undamaged, and in their original packaging.
We cannot accept returns of products that have been opened, unsealed, used, damaged after delivery, or are not in a resaleable condition, unless the product is faulty or incorrectly supplied.
You are responsible for taking reasonable care of the goods while they are in your possession.
14. Return shipping costs
Unless the product is faulty, damaged, or incorrectly supplied, you are responsible for the cost of returning the goods to us.
We recommend using a tracked shipping service. We are not responsible for returned goods that are lost or damaged in transit.
15. Refunds
If you validly withdraw from your purchase and return the goods in accordance with these Terms, we will refund the price paid for the returned goods.
We will normally refund using the same payment method you used for the original order, unless we agree otherwise.
We may withhold the refund until we have received the goods back or until you provide evidence that you have sent them back.
We will not refund additional delivery costs if you chose a delivery method more expensive than our standard delivery option.
16. Faulty, damaged, or incorrect goods
If your order arrives faulty, damaged, or incorrect, please contact us at support@cookskava.com as soon as possible with your order number, a description of the issue, and photos where relevant.
If the product is confirmed to be faulty, damaged before delivery, or incorrectly supplied, we will offer an appropriate remedy, which may include replacement, refund, or another solution required by applicable consumer law.
Nothing in these Terms affects your statutory consumer rights.
17. Responsible use
You agree to use our products responsibly and in accordance with the information provided on our website and product packaging.
You must not misuse our products or use them in a way that may create a health, safety, legal, or regulatory risk.
You must not resell our products unless we have agreed this with you in writing.
18. Website errors
We try to keep the website accurate and available, but errors may occasionally occur.
We may correct errors, update product information, change prices, suspend products, or update these Terms at any time.
If an error affects an order you have already placed, we will contact you and give you the option to continue with the corrected information or cancel the order.
19. Discount codes and promotions
Discount codes and promotions may be subject to additional conditions.
Unless stated otherwise, discount codes cannot be exchanged for cash, cannot be applied retrospectively, and may be withdrawn or changed at any time.
We reserve the right to cancel discounts or orders where we believe a promotion has been misused.

We process personal data in order to handle orders, payments, delivery, customer service, legal obligations, fraud prevention, and website operation.

21. Limitation of liability
We do not exclude or limit liability where it would be unlawful to do so.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, intentional misconduct, or any rights you have under mandatory consumer protection law.
Subject to the above, we are not responsible for indirect losses, business losses, loss of profit, loss of opportunity, or losses that were not reasonably foreseeable when the contract was formed.
22. Events outside our control
We are not responsible for delay or failure to perform our obligations where this is caused by events outside our reasonable control.
This may include courier delays, customs delays, strikes, natural disasters, extreme weather, war, civil unrest, government action, regulatory changes, internet outages, supplier disruption, or payment provider disruption.
If such an event affects your order, we will contact you where reasonably possible.

These Terms are governed by Greek law.

The Terms that apply to your order are the Terms published on our website at the time you place your order.
